Does it sound selfish to divorce someone you are married to just because you are not sexually satisfied with your partner? While it may or may not sound very self-centered to some, some laws validate sexual impotence as a legit reason to divorce someone.

Erectile Dysfunction Epidemic

A relationship is meant to complete two individuals by pairing each of them with their other half or significant other. They complement each other on an emotional, intellectual, and physical level. While most often couples compromise when either of these is missing, it’s not always the case when it’s the physical aspect of a relationship.

Physical relationships provide a sense of being connected to your partner through touch. It is also another way how couples show their love and attraction towards each other. Not only do physical relationships give pleasure, but it is also how couples procreate.

Often, when therapists speak to couples having marital problems, the lack of communication or intimacy in the bedroom turns out to be the underlying reason.

Most often, this inability to perform sexually can be attributed to sexual impotence or other reasons like depression, anxiety, or other issues like loss of interest in the partner, extramarital affairs, or simply loss of libido.

While most of these conditions can be remedied, sexual impotence is often the cause of divorces due to sexual problems and is on the rise. However, it is sometimes misunderstood that sexual impotence occurs only in men.

Divorce Due to Male Impotence in India

According to Indian Law, impotency is the lack or absence of capacity to consummate a marriage by an act of normal, natural, and complete intercourse. It is a state of physical or mental condition which makes consummation of marriage a practical impossibility.

It is important to stress the point that men and women can both be sexually impotent. Often, while filing for divorce, women may claim that the husband is impotent, and most people completely dismiss the fact that the woman could also be impotent/frigid. Recently, the Delhi High Court has ruled that falsely alleging impotency against the husband can amount to cruelty by the woman under the Hindu Marriage Act.

Divorces on the ground of sexual impotence are approved only if the condition is permanent and cannot be treated or cured.

The worst fact about impotency is that people are not always born with it. A perfectly healthy individual who might have been able to indulge in intercourse before might become impotent gradually due to lifestyle habits or even due to injuries and accidents.

Even though sexual impotence is a valid reason to get a divorce, luckily, being sterile cannot be justified as a valid one.

What is Sexual Impotence?

Sexual impotence is the inability to have intercourse with one’s partner, and sterility or infertility is the inability to conceive despite having sex.

Between the years 2012-2017, sexual impotence was one of the major causes of divorces in India. In the year 2013, there was something known as the ‘impotence epidemic‘ that was doing rounds in the news as impotency became the primary cause of tension amongst couples.

However, as the years have gone by, impotency is no longer the leading cause for divorce, as many other reasons like domestic violence, problems with in-laws, increased financial independence in women (giving strength to opting out of an unhappy marriage), and others have become more prominent and common. Sexual impotence is now only one of the major causes of divorce in India and not the leading one.
